FERPA privacy regulations

NSBA has filed comments regarding the U.S. Department of Education’s (ED) proposed regulations that address a range of issues under the Family Educational Rights & Privacy Act (FERPA). NSBA’s comments address almost every issue raised by ED including proposed changes to the health and safety emergencies exception. Other major issues NSBA commented on include: (1) the revised definition of personally identifiable information; (2) the expansion of the school official exception; (3) access to education records by school officials; (3) disclosures to a school where a student seeks to enroll; (4) de-identification of information; and (5) identification and authentication of identity.
