Family and Medical Leave Act changes

The Department of Labor has issued proposed rules related to the Family Medical Leave Act (FMLA). Among the issues the proposed rules address: joint employer coverage, definition of eligible employee, serious health condition, intermittent leave or reduced schedule leave, transfer to an alternative position, substitution of paid leave, employee right to reinstatement, employer notice requirements, content of medical certification, and the passage of the Health Insurance Portability and Accountability Act. The proposed rules also address the National Defense Authorization Act, which amends the FMLA to provide leave for employees to care for injured service members and because of any qualifying exigency arising out of family member on or being called up for active duty. For background, see the NSBA link. DOL must receive comments by April 11, 2008.
